BUENAS NUEVAS DESDE BRUSELAS CONTRA EL PROZAC
Palabras pronunciadas por Juan Pundik, Presidente de la Plataforma contra el Prozac y la medicalización de la infancia en el Forum extraordinario de los Forum Psy y la Revista Le Nouvel Äne, en París el sábado 24 de noviembre del 2007.
Estimados amigos:
A raíz de un dictamen favorable de EMEA (Agencia Europea del Medicamento),de junio del 2006, para la utilización del PROZAC (fluoxetina) en niños, solicitado por su fabricante los laboratorios Lilly, y vistas las reacciones adversas sobre las que el prospecto del propio laboratorio advierte, constituí mediante convocatoria por correos electrónicos una PLATAFORMA CONTRA LA MEDICALIZACION DE LA INFANCIA y reunidas suficientes firmas me dirigí, en junio del 2006, al Presidente de la Comisión Europea Don Jose Manuel Durao Barroso, solicitándole que no avalara con su firma el dictamen de EMEA.
Al no recibir acuse de recibo ni respuesta reiteré el texto, hasta que a la 5ª reiteración recibí una respuesta que le había sido encomendada, no a los responsables de Salud Pública y Defensa del Consumidor sino, a Don Martín Terberger, Jefe de Unidad de Productos farmacéuticos de la Dirección General de Empresa e Industria, lo cual me pareció el colmo de lo descarado. De todo esto dí cuenta al entonces Presidente del Parlamento Europeo Don Josep Borrell que dió curso oficial a mi queja sobre falta de TRANSPARENCIA EN LA COMISION EUROPEA.
Con fecha 25.10.07 recibí correo de Alina Vasile, Secretaria del Comité de Peticiones del Parlamento Europeo informándome que la Comisión se reunía el 22.11.07 a las 17 horas para considerar el informe de la Comisión Europea y mi solicitud y me invitaba a hacerme presente y pronunciar un alegato.
A pesar de que no era mi primera visita a Bruselas, un recorrido exploratorio al edificio del Parlamento Europeo en donde estaba citado para las 17 horas me permitió comparar el enorme contraste entre la antigua capital de esta hoy conmocionada y escindida Bélgica, con su catedral y sus monumentos y los rascacielos de la gigantesca burocracia europea. La visita me permitió entrever lo que pagamos los europeos para mantener este pacífico ejército que salvaguarda nuestra democracia que, aunque corrupta, es la atenta vigía y custodia de nuestros derechos y libertades.
Vuelto ya a la sede del Parlamento, fui recibido en la entrada por una secretaria de la Comisión de Peticiones que me colocó la tarjeta de identificación para atravesar los sistemas de seguridad del imponente Sancta Sanctorum. Entramos a la Sala de la Comisión. No me esperaba el enorme hemiciclo de tipo parlamentario. Arriba, quince cabinas para los traductores simultáneos. En cada cabina, varios traductores. Es la Sala de una de las Comisiones que funcionan durante todo el día. Los escaños delanteros para los europarlamentarios y representantes de organismos acreditados, los de atrás, para los peticionantes. Cascos para la traducción. Presidente polaco, secretarios varios de este melting pot que ha venido preparando nuestro convivenciable mestizaje desde hace miles de años atrás.
Los peticionantes anteriores venían de Irlanda, a quejarse de sus corruptos ayuntamientos que para saltarse las normas europeas, sobre prevención medioambiental y protección de yacimientos arqueológicos e históricos en la construcción de presas y carreteras, dividían sus proyectos por partes de manera tal que por ser entonces varios proyectos pequeños, estaban exentos de cumplir con los reglamentos e investigaciones pertinentes. El Ayuntamiento de Cork se había llevado por delante yacimientos arqueológicos y cementerios para construir carreteras. El de Tara había construido una presa sin estudios medioambientales. Acusaban a sus ayuntamientos de constituirse en juez y parte y de violar el ordenamiento jurídico que no le permite ser juez y parte. Argumento al que me remití posteriormente ya que la Agencia Europea del Medicamento también violaba esta tradición jurídica al permitir a los laboratorios ser jueces y partes en las autorizaciones de sus productos.
Llegó mi turno. Y pronuncié mi alegato:
Excelentísimos señores eurodiputados de la Comisión de Peticiones del Parlamento:
Vengo a solicitar vuestra intervención para que este Parlamento:
1º. Vete o derogue la Decisión C(2006) 3842 que autoriza la administración de Prozac ( fluoxetina) a niños y adolescentes menores de 18 años concedida por la mera petición del fabricante del producto, los Laboratorios Lilly.
2º. Derogue el artículo 6 del Reglamento de la Comisión Europea que permite un funcionamiento anómalo y ajeno a nuestro orden y tradiciones jurídicas como lo es el delegar en el solicitante de la autorización la investigación sobre los beneficios de la medicación por él producida, de sus contraindicaciones y posibles efectos adversos.
3º. Abra una investigación sobre la validez científica de las autorizaciones concedidas por la EMEA a los productos medicinales mediante este aberrante procedimiento.
4º. Establezca un ordenamiento jurídico transparente mediante el cual las autorizaciones para la administración de las sustancias medicinales se concedan mediante estudios, pruebas e investigaciones realizadas por organismos que sean garantía de independencia de la industria farmacéutica.
Es innumerable la cantidad de estudios e investigaciones publicadas en los últimos años que establecen que el enorme aumento del uso de antidepresivos que incrementan los niveles de serotonina, y que son administrados a menudo en combinación con otros fármacos, que también elevan esos niveles, constituyen una amenaza para la salud y la vida del paciente. Estudios e informes que me he ocupado de enviar, y de los cuales la Comisión Europea no ha tomado conocimiento, considerando válido el solo informe del laboratorio fabricante.
Se está concediendo a los profesionales médicos autorización para decidir cuáles de nuestras ideas o conductas deben ser rotuladas, diagnosticadas, tratadas, medicadas e incluso drogadas con el beneplácito de la Comisión Europea. El sistema democrático, tan trabajosamente conquistado, corre el riesgo de estar dando paso, muy veladamente, a un nuevo tipo de estado totalitario que pretende clasificar a niños y jóvenes en adictos, angustiados, depresivos, fóbicos, anoréxicas, bulímicas, atacados de pánico, bipolares, asmáticos, epilépticos, hiperactivos, etcétera; y someterlos a medicaciones segregacionistas y minusvalidantes, que borran de un plumazo los derechos y libertades individuales por cuya conquista han luchado e incluso sacrificado sus vidas generaciones enteras de seres humanos que sentaron las bases de la sociedad democrática en la que vivimos.
Vengo a comparecer a Bruselas ante esta Comisión de eurodiputados del Parlamento Europeo en representación de la Plataforma contra la medicalización de la infancia, que cuenta ya con mil adhesiones, para defender la dignidad humana, la libertad, la democracia y los derechos del hombre, y en particular de las futuras generaciones, que están corriendo el riesgo de ser reemplazados por los derechos del mercado representado por las multinacionales.
Muchas gracias por la oportunidad que me habéis brindado de presentar este alegato y esta solicitud.
Las peticiones anteriores habían provocado escasas intervenciones de los europarlamentarios presentes. La mía produjo la multitudinaria demanda de pedidos de palabra. Dos para defender las bondades del Prozac, la confianza en las investigaciones del laboratorio fabricante, la responsabilidad de los médicos que debían administrarla y la responsabilidad de la Comisión Europea, La mayoría de los europarlamentarios utilizó los datos de mi presentación para cuestionar la administración de antidepresivos en infancia y adolescencia.
Una joven representante de la Comisión Europea, defendió la posición de la Agencia Europea del Medicamento y de la Comisión, alegando que habían tomado en cuenta las investigaciones que yo mencionaba y se habían inclinado por las ventajas de la administración del Prozac en niños y Adolescentes deprimidos, previo fracaso de tratamientos psicoterapéuticos y demandando a los profesionales médicos precauciones a la hora de recetar Prozac en infancia y adolescencia.
Me dieron un nuevo turno de intervención para responder, durante el cual insistí en mi acusación de falta de transparencia y seriedad por parte de la Comisión Europea y de la Agencia Europea del Medicamento y de la corruptela legalizada de sus reglamentaciones que permitían a los laboratorios constituirse en juez y parte como en los casos de los ayuntamientos de Cork y Tara. Les hice saber que las cartas, que obran en mí poder, recibidas del jefe de Unidad de Productos Farmacéuticos de la Dirección General de Industria y Comercio de la Comisión Europea, reconocían que no tenía conocimiento de las investigaciones que yo incluía en mi informe.
Insistí en mi consideración de que las respuestas emitidas por la Comisión Europea a través de esa Dirección General, ya eran una demostración de su corrupción, ya que no estábamos ante temas ni de Industria ni de Comercio, sino de Salud Pública, de Defensa del Consumidor, de derechos y libertades individuales. Que la Comisión Europea no me merecía la más mínima confianza cuando días atrás su presidente había reconocido que su apoyo a la invasión de Irak había sido obtenido mediante engaños, que la industria farmacéutica también los engañaba, que estaban sometidos no sólo a los engaños de los laboratorios farmacéuticos sino también a las directivas de la FDA de los Estados Unidos, que actualmente está siendo investigada por el Senado Norteamericano por corrupción, por recibir subsidios de la industria farmacéutica. Manifesté mi opinión de que había que investigar si la Agencia Europea del Medicamento recibía también subsidios de la industria farmacéutica para autorizar sus productos. Que si bien la industria farmacéutica nos brindaba las sustancias que prevenían la enfermedad, protegían nuestra salud y nos curaban, también habían sido los inescrupulosos generadores de los monstruos producidos por la talidomida, de las muertes consecuencia de la administración del antiinflamatorio Vioxx, ahora prohibido, y de centenares de medicamentos cuya autorización es anualmente revocada por las consecuencias iatrogénicas aparejadas que se descubren tardíamente cuando las personas ya han sufrido sus consecuencias, incluida la muerte.
El Presidente me informó que me había excedido en el uso de mi palabra, que me agradecía mi presencia y mi intervención, que mantendría abierta la investigación sobre el tema sobre el que solicitaría información ampliatoria. Varios europarlamentarios, representantes de organizaciones acreditadas y de la prensa, se me acercaron para felicitarme por mi valiente denuncia, y pedirme los textos de mi documentación y mis libros sobre el tema de los cuales había llevado ejemplares para su distribución. Salí de la reunión contento, satisfecho, fortalecido con la convicción de que esto tiene que ser sólo el comienzo. Que la lucha continúa. Que el inconsciente y el psicoanálisis requieren una política. Que hay un amplio margen y posibilidades para la militancia política en los organismos de la Unión Europea que son desconocidos e infrautilizados por sus ciudadanos, y que debemos tenerlos en cuenta en nuestros objetivos, porque son más accesibles y democráticos que los organismos de nuestros gobiernos nacionales.

Dinamarca, como todo, se ha globalizado. La vuelta a la militancia me ha metido en la máquina del tiempo. Me hace sentir 30 años más joven. Os recomiendo la receta de todo corazón. No vaciléis en probarla.
El problema es que esto sólo debería ser el comienzo y que la lucha de la Plataforma debe continuar. Hasta ahora lo he hecho prácticamente sólo, casi en una sola dirección. Ahora se abren los caminos en todas las direcciones. En la dimensión de lo local, en relación a colegios, hospitales, colectivos profesionales y de cualquier otro tipo, ante organismos oficiales como ayuntamientos y otros, ante autoridades nacionales, como ministerios, diputados, senadores y europarlamentarios y por supuesto ante Bruselas. Tenemos que llevar adelante la Plataforma como una organización de la que cada uno y cada una seáis voceros de esta lucha política contra la medicalización de la infancia y de la vida cotidiana. Espero ideas, propuestas y ofrecimientos.

Dear friends,
In June 2006, the EMEA (European Medicines Agency) approved Lilly laboratory’s request allowing the prescription of PROZAC (fluoxetine) to children. Given this, as well as the undesirable side effects indicated by the laboratory itself on the notice accompanying the drug, determined me to create THE PLATFORM AGAINST PROZAC AND THE MEDICALISATION OF CHILDHOOD by means of an electronic list appeal. In June, once I had collected a sufficient number of signatures, I addressed the President of the European Commission, Mr. José Durao Barroso, in order to request his non-endorsement of the EMEA’s approval.
Receiving neither acknowledgement of receipt nor reply, I repeatedly addressed him my letter, until, on my fifth correspondence I received a letter confided not to those in charge of Public Health and Consumer Defense, but to Mr. Martin Terberger, Head of the pharmaceutical products unit of the Directorate-General for Business and Industry. This seemed to me a height of impudence. I gave an account of this to the President of the European Parliament, Mr. Josepe Borrell, who took official action on my complaint for reasons of absence of TRANSPARENCY TO THE EUROPEAN COMMISSION.
I received a letter, dated 10/25/2007, from the Secretary of the Committee of Petitions of the European Union, Alina Vasile, informing me that the Commission would be meeting on 11/24/2007 at 5 p.m. in order to examine the European Commission’s report and my petition. She invited me to attend and to present a defense speech.
Although this was not my first trip to Brussels, a reconnaissance tour of the European Union edifice where I had a meeting at 5 p.m., allowed me to compare the old capital of today’s drastically changing and divided Belgium, with its cathedral and monuments in such sharp contrast to the skyscrapers that lodge the gigantic European bureaucracy. This visit offered me a chance to see what we, Europeans, are paying to up keep this pacific army that watches over our democracy and that, although corrupt, is the attentive sentinel and guardian of our rights and liberties.
On my return to the seat of Parliament, a secretary of the Petitions Commission who gave me the ID badge required to pass the security systems of the imposing Sancta Sanctorum received me at the entrance. We entered the Commission Room. I was not expecting the immense Parliamentary style hemicycle. Above, fifteen booths for translators. In each, several translators. This is the room of one of the commissions that functions all day long. The front row seats are for the European Parliament and accredited organizations, those at the back, for the petitioners. Headphones for the translation. Polish President, various secretaries of this melting pot where our ability for coexistent crossbreeding has been in preparation for thousands of years.
The preceding petitioners came from Ireland to make a complaint about their corrupt mayors who, in order to get around European norms concerning environmental protection and the safeguard of archaeological and historical remains during the construction of a dam and roadways, were dividing their projects into smaller ones. In this way, they were dispensed from both European reglementation and appropriate inquests. In Cork, the Mayor’s office had destroyed archeological sites and cemeteries in order to build roadways. In Tara, theirs had built a dam without any environmental studies. They accused their Mayors’ office of constituting themselves both judge and judged, and of violating the jurisprudence that forbids them to do just that. I later used this same argument, since the European Medicines Agency also violates the juridical tradition that prohibits being both judge and judged when it allows laboratories to act as judge and judged for the authorizations of their own products.
It is my turn, I pronounce my defense speech.
Deputies of the European Commission of Petitions of the European Parliament,
I have come to solicit your intervention so that this Parliament:
1. Oppose it’s veto or derogate the Decision C (2006), authorizing the prescription of Prozac (fluoxetine) to children and adolescents under the age of 18 years, granted to the product’s manufacturer, Lilly Laboratories, by simple application.
2. Derogate article 6 of the European Commission regulation that allows operations that are abnormal and alien to our juridical traditions, like mandating the applicant for an authorization to do the research on the positive effects, the contraindications and possible side effects of the medication manufactured by that same applicant.
3. Open an inquest on the scientific validity of the authorizations given to medical products by the EMEA that make use of this aberrant procedure.
4. Establish a ruling of transparent justice by which authorizations for medicinal substances be granted after studies, proofs and inquests have been carried out by organizations presenting guarantees of independence in regard to the pharmaceutics industry.
Countless studies and inquests published over these past years establish that the enormous increase in the use of antidepressants that increase serotonin levels, often prescribed in association with other drugs that further increase serotonin levels, constitute a threat to the health and the life of the patient. The European Commission did not take these into account, holding as valid the report issued by the manufacturing laboratory alone.
We grant medical professionals the right to decide which of our ideas and behaviors should be written up, diagnosed, treated, prescribed for, and even drugged, with the assent of the European Commission. This democratic system, so painstakingly acquired, runs the risk of giving way, in a very veiled form, to a new sort of totalitarian State that pretends to class children and young adults as dependant, anxious, depressive, phobic, anorexic, bulimic, panic attacked, bipolar, asthmatic, epileptic, hyperactive, etc. and submits them to prescription drugs that have invalidating and segregating effects. This would simply eradicate in a single stroke of the pen the individual rights and liberties, fought for and won by entire generations of people, some of whom sacrificed their lives, in the founding of the democratic society in which we live.
I have come to appear here in Brussels before this Commission of the Deputies of the European Parliament as the representative of the Platform against the Medication of Childhood –that already counts one thousand memberships– to defend the human dignity, the liberty, the democracy and the human rights of future generations, in particular those whose rights are at risk of being replaced by the rights of the market, represented by multinationals.
I thank you for offering me this opportunity to present this defense speech and this petition.
The Preceding petitions had provoked only rare interventions by the members of the European Parliament present. Mine produced a swell of requests to take the floor. Two were to defend the goodness of Prozac, the confidence in the studies produced by the manufacturing laboratory, the responsibility of the doctors who were supposed to prescribe it, and the responsibility of the European Commission. The majority of the members of Parliament used the elements from my paper to ask questions about the prescription of antidepressants to children and young adults.
One young representative of the European Commission defended the European Medicines Agency and the Commission. She alleged that the studies I mentioned had been taken into consideration, and that it had opted for the advantages of prescribing Prozac to children and depressed adolescents, when prior therapeutic treatments had failed. This, along with a recommendation of prudence to medical professionals when prescribing Prozac to children and adolescents.
I was again given time for a reply. I insisted on the lack of transparency and serious study of which I accused the European Commission and the European Medicines Agency, as well as the legalized corruption of rules that allow laboratories to constitute themselves judge and judged, as was the case for Mayor’s offices of
I insisted that, in my opinion, the responses emanating from by the European Commission via this Directorate General were themselves a demonstration of the Directorate’s corruption since we were faced with questions that did not deal with industry and commerce, but with Public Health, Consumer Defense and individual rights and liberties. That it was impossible to accord the slightest confidence to the European Commission when, a few days earlier, its President had admitted that his support of the invasion of Iraq had been extorted from him through lies, when the pharmaceutical industry was lying to them as well, when they were subjected not only to the lies of the pharmaceutical industry but to the American FDA as well–an FDA presently undergoing a U.S. Senate investigation on grounds of corruption for having accepted funding from the pharmaceutical industry. I expressed my opinion on the necessity of opening an inquiry to establish whether or not the European Medicines Agency was also receiving funds from the pharmaceutical industry to gain authorizations for its products. That, although the pharmaceutical industry offers us the substances with which we fight disease, protect our health and treat illness, it has also been unscrupulous. It was responsible for the monsters produced by thalidomide, the deaths caused by the anti-inflammatory drug Vioxx, since called of the market, as well as for hundreds of other drugs that get taken off the market each year once their associated iatrogenic consequences, discovered too late, have induced suffering and even death.
The President informed me that I had exceeded my speaking time, that he thanked me for my presence and my paper, that he would keep open the inquest on this topic for which he required more ample information. Several European Parliamentarians, representatives of accredited organizations and members of the press came to congratulate me for having lodged this courageous complaint and asked me for copies of my information and my books on the subject, a few of which I had brought along to distribute. I left this meeting feeling happy, satisfied and encouraged in my conviction that this must only be a beginning. That the battle must continue, that the unconscious and psychoanalysis require politics, that there is room, there are possibilities, for political militancy in the agencies of the European Union that are little known and insufficiently exercised by its citizens, and that we must take this into account in our objectives because they are more accessible and more democratic that our national governments.

The problem is that this must be but a beginning and that the Platform’s fight must continue. Now paths are opening in all directions. Locally, in relation to schools, hospitals, professional collectives and others of very different sorts, face to face with official organizations, like mayor’s offices and the like, with government ministers, deputies, senators and European parliamentarians, and of course, face to face with Brussels. We must carry on with the Platform as an organization for which each of us is the spokesperson in this fight against the medication of childhood and of everyday life. I am waiting for ideas, propositions and offers.
